Fort Lauderdale HAMP Lawyer

Helping People Stay in Their Homes

In response to the recent and ongoing mortgage crisis, the federal government created the Home Affordable Modification Program (HAMP). The program is designed to help people remain in their homes by lowering their monthly mortgage payments to a more manageable level. To find out if you are eligible for the program, you should work with a skilled lawyer who understands the process.

You will find that kind of attorney at the Law Offices of Michael H. Johnson, P.A. With offices in Fort Lauderdale and West Palm Beach, we have extensive experience helping homeowners use the HAMP program to stay in their homes. If for some reason you do not qualify for HAMP, we are prepared to advise you of your other options, which may include Chapter 7 or Chapter 13 bankruptcy.

To arrange a free initial consultation to discuss the HAMP program with an experienced Florida attorney, please call 954-535-1131 or 561-353-1131. You can also contact our law firm online. We offer flexible payment options, and we answer phones 24 hours a day. Evening, weekend and off-site appointments are available, and our phones are answered 24 hours a day, 7 days a week.

Understanding the Home Affordable Modification Program

The HAMP program is a special form of loan modification. Simply put, a loan modification is a way to avoid foreclosure by working with your lender to change the terms of your mortgage. Different types of home loan modifications may be available depending on your specific financial circumstances:

  • HAMP: If you qualify for HAMP, the bank may agree to decrease your monthly payments to 31 percent of your gross monthly income. To lower your monthly payments, the bank may extend the term of the loan out to 30 or 40 years, or may lower the interest rate to as low as 2 percent.
  • Federal home loans: The Federal Housing Administration (FHA) has its own version of HAMP for homeowners who have federal home loans. The FHA also offers a loan modification program called "partial claim." In a partial claim, up to 12 months' worth of overdue payments can be placed into a separate second mortgage with no payments due.
  • Negotiate directly with your lender: If you do not qualify for HAMP, we can help you negotiate with your bank in an attempt to modify the mortgage. The bank chooses to reduce your interest rate or extend the loan term to lower your payments.

Your eligibility for HAMP depends on a number of factors. When you visit our office, we can explain them to you in detail. You should know, however, that one basic requirement is that you need to have taken your loan out on or before January 1, 2009.
